These Terms of Service ("Terms") constitute a legally binding agreement between you and TECHTS ("Company," "we," "us," or "our") regarding your use of our website, services, and products.

TECHTS provides the following services:

The specific scope of services for each project will be detailed in a separate service agreement or statement of work. We reserve the right to modify, suspend, or discontinue any part of our services at any time with or without notice.

As a user of our services, you agree to:

• Maintain the confidentiality of any account credentials
• Use our services only for lawful purposes
• Not interfere with or disrupt our services or servers
• Not attempt to gain unauthorized access to our systems
• Comply with all applicable laws and regulations

Payment terms for our services are as follows:

• Fees are due as specified in your service agreement or statement of work
• Payment schedules may include upfront deposits, milestone payments, or monthly installments
• Late payments may incur additional charges or interest as specified in the agreement
• All prices are subject to change with notice for new projects
• You are responsible for any applicable taxes, duties, or fees
• Payment methods accepted include bank transfer, credit card, and other methods as agreed
• Refunds are subject to our refund policy and the terms of your service agreement

We reserve the right to suspend or terminate services for non-payment. If payment is not received within the specified timeframe, we may pause work until payment is received.

All content, trademarks, and intellectual property on our website and in our services are owned by TECHTS or our licensors. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or logos without authorization
• Reverse engineer or attempt to extract source code
• Create derivative works based on our services
• Remove or alter any copyright or proprietary notices

Custom Development: For custom AI systems and solutions developed specifically for you, intellectual property rights will be as specified in your service agreement. Typically, you will own the custom solution, while we retain rights to our underlying technology, frameworks, and methodologies.

Client Content: Any content you provide to us remains your property, but you grant us a license to use it for providing our services and for our business purposes (e.g., case studies, with your consent).

To the maximum extent permitted by law, TECHTS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Service interruptions or downtime
• Third-party actions or content
• Security breaches or data loss
• Delays in service delivery
• Incompatibility with third-party systems

Our total liability shall not exceed the amount paid by you for the specific services in the 12 months preceding the claim, or the amount specified in your service agreement, whichever is less.

We are not liable for any damages resulting from your use of AI systems in ways not intended or recommended by us, or for decisions made based on AI-generated outputs without human review.

Cancellation by Client: You may cancel services in accordance with the terms specified in your service agreement. Cancellation terms may include:

• Written notice requirements (typically 30 days for ongoing services)
• Payment obligations for work completed up to the cancellation date
• Payment for materials or resources already procured
• Early termination fees, if applicable

Cancellation by TECHTS: We may terminate or suspend your access to our services immediately, without prior notice, for any reason, including if you:

• Breach these Terms or your service agreement
• Fail to make payments as required
• Engage in fraudulent or illegal activities
• Misuse our services or systems

Upon termination, your right to use our services will cease immediately. We may delete your account and data at our discretion, subject to any data retention requirements.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties regarding accuracy, reliability, or completeness
• Warranties of non-infringement
• Warranties that services will be uninterrupted or error-free
• Warranties regarding AI system performance or outcomes

We do not guarantee specific results or ROI from our AI solutions. Results depend on various factors including your business context, implementation, and market conditions.

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to conflict of law principles.

Any disputes arising from these Terms or our services shall first be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the Malaysian Arbitration Act, or through the courts of Malaysia, as applicable.

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on our website and updating the "Last updated" date.

Your continued use of our services after such modifications constitutes acceptance of the updated Terms. If you do not agree to the changes, you should discontinue use of our services.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.
